Privacy Policy
The Public Procurement Commission operates the Data Visualisation and Business Intelligence (DVBI) Portal which provides contractor and consultant monitoring services for procuring entities within Jamaica.
This Privacy Policy is used to inform users and visitors about our policies and procedures for the collection, use and disclosure of Personal Data on the DVBI Portal.
If you choose to use our Service, then you agree to the collection and use of information in relation with this policy. The Personal Data that we collect are used for providing and improving the Service. We will not use or share your information with anyone except as described in this Privacy Policy.
Interpretation and defination
In this Policy-
Account means an account created to access and use the Site;
Cookies mean small files that are placed on your computer or electronic device by a website, containing the details of your browsing history on that website on among its many uses;
Data Controller, for the purposes of section 2 of the DPA, refers to the PPC as the legal person which alone or jointly or in common with other persons determines the purposes and means of the processing of Personal Data;
DPA means the Data Protection Act, 2015;
Personal Data, for the purposes of section of 2 of the DPA, means any information relating to the user or visitor who can be identified from that information alone or from that information and other information in the possession of the Data Controller;
Process, for the purposes of section 2 of the DPA, means obtaining, recording or storing the information or personal data, or carrying out any operation or set of operations (whether or not by automated means) on the information or data including-
- organisation, adaptation or alteration of the information or data;
- retrieving, consulting or using the information or data;
- disclosing the information or data by transmitting, disseminating or otherwise making it available; or
- aligning, combining, blocking, erasing or destroying the information or data, or rendering the data anonymous;
Service means the operation of the Site to monitor contractor and consultant performance for public procurement projects and contract within Jamaica;
Site means the DVBI Portal and its accompanying applications.
PPC means the Public Procurement Commission.
Data Protection Standards
The PPC is committed to ensuring compliance with the data protection standards as articulated by the DPA. As the Data Controller, the PPC shall ensure that the following principles are adhere to when processing Personal Data on the Site-
- fairness and lawfulness;
- purpose limitation;
- data minimisation;
- accuracy;
- storage limitation;
- protection against unauthorised use, transfer or access.
The PPC shall not retain any Personal Data for any period longer than its intended use or as provided by the DPA or the Public Procurement Act, 2015.
Information Collection
Personal Data
While using our Site, we may require you to provide us with certain Personal Data that may be used to contact or identify you. Personal Data may include, but is not limited to-
- email address;
- first name and last name;
- phone number;
- address;
- occupation;
- employer;
- signature;
- contract details for consultant/ contractor;
- usage data.
Usage Data
Usage data is collected when using the Site. Usage data may include information such as your device’s internet protocol address, browser type, browser version, the pages of our Site you visit, the time and date of your visit, the time spent on those pages, and other statistics.

The PPC may use your Personal Data for the following purposes-
- to provide and maintain our services on the Site, including monitoring the usage of our Site;

- for monitoring contractor or consultant performance: to fulfil the PPC’s statutory obligations as a regulator and facilitator of the public procurement process, the Personal Data provided by you will be used to monitor the compliance and implementation of the procurement contracts and projects;
- to contact you by email, telephone calls, SMS or other forms of electronic communication related to the Site and service;
- to manage and respond to your requests;
- for other purposes: we may use the information for other purposes, such as data analysis, reporting obligations or any other legal/statutory obligations to the relevant government authority, and determining the effectiveness of the Site and service.
Disclosure
We may share your Personal Data in the following situations-
- with service providers: we may share your information with service providers to monitor and analyse the use of our Site.
- with affiliates: we may share your information with our affiliates, in which case we will require those affiliates to honour this Privacy Policy. Affiliates include our parent Ministry, branches of the PPC, and any other relevant government ministry, department or agency.
- with your consent: we may disclose your information for any other person with your consent.
Your Rights
Under the DPA, you have the following rights in relation to your Personal Data:
- to access the Personal Data held by the PPC about you;
- to have your Personal Data corrected, if it is incomplete or incorrect;
- to opt out of receiving marketing communications at any time;
- to receive a copy of the Personal Data which you have provided subject to applicable laws;
- to restrict or object to the processing of Personal Data in certain circumstances, and subject to applicable law;
- the right to seek readdress from the Office of the Information Commissioner.
